Respect NATO Allies Act

Sponsored By: Representative Sánchez, Linda T. [D-CA-38]

Introduced

Summary

Congress must approve new tariffs or quota cuts on imports from NATO allies. The Respect NATO Allies Act would bar the President from imposing or raising tariffs or from reducing quotas or tariff-rate quotas on goods from any NATO member or covered territory unless Congress enacts a specific joint resolution approving the action.

  • NATO exporters and U.S. importers would gain more predictability because new tariffs or quota cuts could not take effect without congressional approval. There are explicit exceptions for antidumping and countervailing duties, actions under the Trade Act, and duties tied to certain international dispute settlement rulings.
  • The President's unilateral authority over tariff increases and quota reductions for NATO partners would be limited, making those trade decisions contingent on Congress through a defined approval mechanism.
  • Congress would get a formal, expedited joint-resolution process to approve covered tariff or quota changes. The bill also includes a sense of Congress stressing NATO's strategic importance, Arctic security, and concerns about threats from the PRC and the Russian Federation.

Congress must approve NATO tariffs

This bill would stop the President from imposing or raising tariffs or cutting quotas on goods from NATO allies unless Congress enacts a one-issue joint resolution approving that action. The joint resolution would have to say, after the resolving clause, "That Congress approves ___ imposed with respect to ___." The bill would let any Member in either House introduce the resolution and would use expedited trade procedures. The restriction would not apply to antidumping and countervailing duties, certain Trade Act actions, or duties required by some dispute settlement rulings.

Which countries count as NATO allies

This bill would define "NATO ally" to mean any country that is a member of the North Atlantic Treaty Organization. It would also include any territory to which Article 5 of the Washington Treaty applies, including territories described in Article 6. That definition would decide which imports are covered by the bill's limits on changing tariffs, duties, or quotas. This definition would take effect on enactment.
