Snap Back Inaccurate SNAP Payments Act

Sponsored By: Representative Feenstra, Randy [R-IA-4]

In Committee

Summary

Ties state SNAP error liability to how well states recover overpayments and makes recoupment mandatory. The law phases out an older tolerance through fiscal year 2024 and starts a new liability formula in fiscal year 2025 that multiplies error rates by the share of benefits not recouped.

Stricter SNAP overpayment recovery rules

This bill would tighten rules on SNAP payment errors and require states to try to get back overpaid benefits. It would make state agencies seek recoupment of any overpayments upon enactment. Starting in fiscal year 2025, a small-error exclusion used in quality control would be set to $0. For FY2025 and later, the error rate used to set state liability would equal the state error rate times the share of overpayments not recouped. The bill would also change a numeric threshold from 10 to 25 and change a discretionary "may" to a mandatory "shall." If enacted, households could see more requests to repay past overpayments.
