HSA’s For All Act
Sponsored By: Representative Bean, Aaron [R-FL-4]
Introduced
Summary
Broadens HSA eligibility beyond high-deductible health plans to include qualified ACA Exchange plans and employer group health plans. This bill would replace the old HDHP requirement with a new "covered health plan" test that covers qualified health plans offered through ACA Exchanges and group health plans under the Public Health Service Act.
Show full summary
- Families and individuals who buy coverage through ACA Exchanges could open and contribute to Health Savings Accounts if their plan is a qualified health plan. This makes HSAs available to people who previously were excluded because their plan was not a high-deductible plan.
- Workers enrolled in employer group health plans would also become eligible to use HSAs even when their employer plan is not a high-deductible health plan. This could expand HSA access for many employees who get coverage through work.
- The Internal Revenue Code would be updated so multiple tax provisions use the new "covered health plan" definition. The change would apply to taxable years beginning after December 31, 2026.

More people can use HSAs
If enacted, you would be able to open or contribute to a Health Savings Account (HSA) for any month. To qualify, you would only need to be covered on the first day of the month by a "covered health plan." "Covered health plan" would mean either an ACA Exchange qualified health plan or any group health plan. This would remove the current rule that you must have a high-deductible health plan. The change would apply to tax years beginning after December 31, 2026.
