Bill Overview
Analyzed Economic Effects
3 provisions identified: 2 benefits, 0 costs, 1 mixed.
Make VA Inspections Count for Medicare, Medicaid
If enacted, the bill would let State Veterans Homes inspected and certified by the Department of Veterans Affairs be treated as meeting Medicare Conditions of Participation. To qualify, the VA would have to provide inspection reports (survey findings, deficiency statements, and corrective actions) and submit its survey standards and procedures for joint review with CMS at least once every 2 years. The HHS Secretary would approve standards only after consulting with the VA and ensuring VA inspections include CMS survey protocols and enforcement expectations and uphold at least the same care and safety standards. CMS would still be able to investigate complaints, do targeted surveys, impose fines or end participation, and revoke the VA‑based deemed status. The amendments would take effect 90 days after enactment.
Congressional Notice and GAO Review of Deeming
If enacted, the bill would require the HHS Secretary to send written notice to the House Committees on Veterans' Affairs and Energy and Commerce and the Senate Committees on Veterans' Affairs and Finance within 15 days after approving, suspending, or revoking VA deeming standards or finding material non‑alignment with Medicare rules. The bill would also require the Government Accountability Office to report to Congress within 3 years after the law goes into effect on survey efficiency and costs, enforcement comparisons, resident safety outcomes, and recommendations.
Public Reporting for State Veterans Homes
If enacted, the bill would require the HHS Secretary to incorporate VA inspection findings, deficiency statements, and quality metrics for VA‑certified State homes into Nursing Home Care Compare or a successor site, consistent with existing CMS data methods. The Secretary would decide the public format in consultation with the VA. The bill would also require HHS and VA to issue guidance to align certification and data reporting processes for State homes within 180 days after enactment.
