Sponsored By: Representative Roy, Chip [R-TX-21]
In Committee
Summary
Reweights state highway apportionments using each State’s 2012 apportionment share combined with current Highway Trust Fund contributions. This bill would set a new formula that blends a historical base with a revenue-weighted adjustment to decide annual federal highway allocations starting in fiscal year 2026.
Show full summary
- States: Each State would first receive an "initial amount" equal to its share of total 2012 apportionments multiplied by the total funds available for apportionment. This creates a historical baseline tied to fiscal year 2012.
- Contribution-weighted adjustments: That initial amount is then adjusted by an "applicable percentage" that measures the State’s share of estimated highway-user tax payments into the Highway Trust Fund, excluding the Mass Transit Account. The formula uses the most recent year of data available for that calculation.
- Programs and guardrails: The rule applies to combined apportionments for sections 119, 133, 148, 149, 167, 175, 176(c), and funds to carry out section 134. It includes a general adjustment that ensures combined apportionments do not fall below 95 percent of the applicable percentage times total apportionable funds and directs the Secretary to make apportionments each October 1.

New highway funding formula for states
This bill would change how federal highway money is split among States starting in fiscal year 2026. Each October 1, the Secretary would first give each State an initial amount based on the State's share of apportionments in fiscal year 2012. Then those amounts would be adjusted so no State gets less than 95 percent of its applicable percentage times the total amount available. The applicable percentage would be each State's share of estimated Highway Trust Fund tax payments (excluding the Mass Transit Account) for the most recent year with available data. The rule would apply to combined apportionments for the listed highway programs and to activities under section 134.
