Show full summary
- States: A state could adopt a law or certify voter approval that explicitly says the federal parity rule should not apply to loans by institutions it charters. Once adopted or certified, the federal parity rule would not apply to loans made by those state-chartered institutions after that date.
- State-chartered banks and credit unions: Insured depository institutions and insured credit unions chartered by an opting-out state would be exempt from the federal parity framework for loans they make. The bill adds new opt-out language to Section 27 of the Federal Deposit Insurance Act and to Section 205(g) of the Federal Credit Union Act to create this effect.
- Legal and retroactive effect: The bill repeals Section 525 of the 1980 law and says the new opt-out rules govern any state laws or certifications made under that section before enactment.

State opt-out for in-state lenders
This bill would let a State opt out of the federal interest-rate parity rule for loans made by banks and credit unions chartered in that State. The opt-out would apply only to loans made or for which a commitment was entered into after the State adopts the law or certifies voter approval. The bill would also repeal Section 525 of the 1980 Act and say that earlier State laws or certifications under that old rule are governed by the new opt-out rules.
