In Committee
Summary
Block motor carriers tied to listed Chinese military companies from hauling Department of Defense freight. This bill would create a certification and domicile registry regime that applies to every motor carrier, subcontractor, and owner-operator moving DoD cargo and requires proof they are not owned, controlled by, or in significant business relationships with companies on the official list of Chinese military companies.

- Motor carriers and owner-operators would need to submit the certification after reasonable inquiry and keep those records for 5 years. A carrier that knowingly gives a false certification could face suspension or debarment from DoD contracting and criminal penalties under 18 U.S.C. 1001.
- Prime contractors must flow the same certification requirement into all subcontracts and lease agreements so the rule reaches subcontractors and owner-operators at all tiers. This applies to contracts awarded by the United States Transportation Command and the Military Surface Deployment and Distribution Command.
- The Secretary of Defense would have to issue implementing regulations within 180 days and integrate the new requirements into existing carrier approval processes, and the Secretary will define what counts as a "significant business relationship" in those regulations.

New security rules for Defense carriers
If enacted, the FMCSA and the Defense Department would set up a Secure Defense Freight Carrier Registry within one year. Starting one year after enactment, only carriers on the registry could bid on or do DoD freight work. Carriers would need valid FMCSA authority, meet DoD qualification standards, pass owner and worker security vetting, and be revetted at least every two years. Carriers would have to certify, after reasonable inquiry, they are not owned, controlled by, or do not have significant business relationships with companies on the DoD Chinese military company list. Prime contractors would have to flow the same certification into subcontracts and leases. Carriers must keep certification records for at least five years, and false statements could lead to suspension, debarment, or penalties under 18 U.S.C. 1001. The Defense Secretary would issue implementing regulations within 180 days and could grant waivers for exigent circumstances.
