Moral Injury Recognition and Restitution Act

Sponsored By: Representative Carbajal, Salud O. [D-CA-24]

In Committee

Summary

Retroactive disability payments for veterans who experienced military sexual trauma. This bill would add Section 5114 to title 38 so that VA compensation awards tied to military sexual trauma use an effective date of the day after the veteran’s discharge and require monetary benefits to be paid retroactively from that date, overriding the usual timing rules in sections 5110 and 5111. It adopts existing statutory definitions for military sexual trauma and for covered mental health conditions and also covers physical injuries or diseases caused or aggravated by MST.

Retroactive pay for veterans with military sexual trauma

If enacted, veterans with an approved VA compensation claim for a health condition from military sexual trauma (MST) would have the award date set to the day after their discharge. VA would start paying monetary benefits from that date and would pay benefits retroactively back to it. This would apply even if other VA timing rules would normally set a later start date. MST and covered health conditions would use the definitions in current law (38 U.S.C. 1166).
