Every Dollar Counts Act of 2026

Sponsored By: Representative Murphy, Gregory F. [R-NC-3]

Introduced

Summary

Count patient payments toward deductibles and out-of-pocket caps. This bill requires that when people buy a prescription drug without using available plan benefits, their out-of-pocket payment must be credited to the deductible and the out-of-pocket maximum the plan would have applied. It aligns that rule across federal health law, the Employee Retirement Income Security Act, and the tax code so the treatment is consistent for group and individual coverage.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Count covered drug payments toward caps

If enacted, this bill would require group health plans and health insurance issuers to count money you pay out-of-pocket for a covered prescription toward your deductible and out-of-pocket maximum when you choose not to use plan benefits. This counting would apply only to the payments you actually make for that drug. The rule would start for plan years beginning on or after January 1, 2027.

Change drug price reporting rules

If enacted, the bill would change how drug makers report certain discounts. It would require manufacturers to include price reductions tied to purchases made without using insurance when they calculate average manufacturer price (AMP). At the same time, it would exclude those same non-applied discounts from the Medicaid "best price" calculation. These reporting changes would alter rebate and payment formulas that affect Medicaid and other programs, so effects on households would be indirect.
