Commission on Presidential Capacity to Discharge the Powers and Duties of the Office Act

Sponsored By: Representative Raskin, Jamie [D-MD-8]

Introduced

Summary

A congressional medical commission to determine presidential capacity would be created to carry out Section 4 of the 25th Amendment and provide a rapid, medical declaration on whether a President can discharge the office. It sets tight timelines and specific appointment rules for a peer-reviewed examination process.

Show full summary
  • The President and the office: The Commission would conduct a medical and mental exam within 72 hours after Congress directs it and must deliver a report declaring whether the President can discharge duties. The report must address physical illness, mental illness, alcohol or drug use, other incapacities, and any presidential refusal to cooperate.
  • Congress and the Vice President: The report is sent to the Speaker and the President Pro Tempore in consultation with the Vice President and must include any Vice Presidential disagreement and its reasoning. The law permits the Commission to override Health Insurance Portability and Accountability Act privacy rules as needed to prepare the report.
  • Commission membership and independence: The panel would have 17 members chosen by congressional leaders and must include licensed physicians with psychiatry representation and former senior executive officers balanced by party. Members may not hold elected office or be government employees and serve multi-year terms with quick vacancy fills.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

New 17-member presidential commission

If enacted, this would create a 17-member Commission in the legislative branch to assess whether the President can do the job. Congressional leaders and party caucuses would pick most members, and the 16 appointees would choose a separate Chair by majority vote. Each pair of leader appointees would need to include a licensed physician and one psychiatrist. Appointees could not be elected officials, most federal employees, or members of the Armed Forces. Initial members would be named within 10 days after enactment and would serve until January 1, 2031; later successors would serve four-year terms. Commission members would be paid travel and per diem under federal travel rules.

Fast medical exam for presidential fitness

If enacted, Congress would trigger the Commission with a single, named concurrent resolution to examine the President. The Commission would have to start the exam within 72 hours of that resolution and send a written report within 72 hours after the exam. The report would state whether the President can discharge the office, explain the medical findings, note any Vice President disagreement, and record any Presidential refusal to be examined. The bill would let the Commission get and share medical information for this process even when HIPAA would otherwise block it. It would also speed up congressional consideration of the resolution (for example, replacing a 20-day review with a 48-hour window and treating Armed Services committee references as Judiciary committee references).
