Federal crime for fertility DNA fraud

If enacted, the bill would make knowingly misrepresenting the DNA or its source used in fertility treatments a federal crime. The offense would cover IVF, handling of eggs or embryos, and assisted insemination involving sperm. Violators could face a fine, up to 10 years in prison, or both. Federal jurisdiction would apply when the case involves interstate travel, communications, payments, or items that crossed state lines, or U.S. territorial jurisdiction. The bill would also add the new offense to the racketeering (RICO) list and let prosecutors or private plaintiffs treat it as racketeering activity. Finally, when DNA testing identifies a suspect, prosecutors could bring charges for up to 10 years after that identification.
