  • Recipients and project sponsors (including those funded under chapters 229, 243, or 249 of title 49) may use Federal Transit Administration assistance to purchase, lease, or otherwise secure real property interests for passenger rail projects before or during environmental review. They may not physically develop or improve that property in anticipation of the project until all required environmental reviews are complete.
  • The Administrator of the Federal Transit Administration must update FTA Circular 5010.1F or any successor circular and any other necessary guidance to implement these changes within 6 months.
  • The law replaces language about "corridor preservation" and "right-of-way" with "real property interests," broadening the statutory scope to explicitly include acquired property interests for passenger rail projects.
