Energy Consumer Protection Act of 2026

Sponsored By: Representative Schakowsky, Janice D. [D-IL-9]

Introduced

Summary

Gives the Federal Energy Regulatory Commission new powers to block, suspend, and fine actors who manipulate or lie about electricity and natural gas markets. It broadens who and what the Commission can punish and adds a new anti-fraud rule for gas market reporting.

Show full summary
  • Traders and energy firms: The bill lets the Commission prohibit or suspend any person who violates specified Federal Power Act rules from purchasing or selling electric energy, electric energy products (including financial transmission rights), or transmission services.
  • Natural gas sellers and reporters: It creates a new Natural Gas Act ban on knowingly false filings meant to affect price data used by federal or private price-reporting agencies and authorizes civil penalties and suspensions for violators.
  • Regulatory reach and consistency: The text replaces "individual" with "person," covers indirect engagement, and explicitly includes electric energy products, so penalties can apply more widely across companies, intermediaries, and trading products.

Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 3 costs, 0 mixed.

Ban on false gas price reports

If enacted, it would be unlawful for any person to willfully and knowingly report false information to a Federal agency or a private price‑reporting agency about the transportation or sale of natural gas when the person intends to fraudulently affect the compiled data. Covered information would include availability and wholesale prices of natural gas and information about the operation of transportation or sales facilities. This prohibition would take effect upon enactment.

New bans on electricity market participants

If enacted, the Commission would be able to bar or suspend any person who engaged in practices that violate sections 221 or 222 from buying or selling electric energy, electric energy products (including financial transmission rights), or transmission services under its jurisdiction. The ban could be permanent or for a time the Commission sets and could stop direct or indirect participation. The bill would change statutory language (replacing “individual” with “person”) so these prohibitions reach more market actors. This would take effect upon enactment.

New bans on natural gas traders

If enacted, the Commission would be able to prohibit or suspend any person who engaged in practices that violate sections 4A or 4B from buying or selling natural gas or providing transmission services under its jurisdiction. The ban could be permanent or time-limited and could reach both direct and indirect participation. The bill would amend statutory text (replacing “individual” with “person”) to broaden who the Commission can bar. This would take effect upon enactment.
