Defines heirs property for homeowners
This bill would direct the Secretary of Agriculture to study and report to Congress by September 30, 2026, on ways 1890 land-grant institutions can provide education and technical help about transferring farms and ranches. For that study, the bill would define "heirs property" as real property held in tenancy in common when a partition action is filed and the property meets specific tests. The tests are: no recorded agreement binding all co-owners; at least one co-owner got title from a relative; and one of these 20% tests applies: (A) 20% or more of interests are held by relatives, (B) 20% or more of interests are held by someone who got title from a relative, or (C) 20% or more of co-owners are relatives. The definition would take effect upon enactment and would guide the study and related analysis.
