Introduced
Summary
Redesignation based on out-of-state or international emissions. This bill would let a Governor ask the EPA to redesignate an ozone nonattainment area as attainment when the State shows the area would have met the national ambient air quality standard for ozone but for emissions coming from other States or foreign countries.
Show full summary
- Governors and States: A Governor could submit a finding at any time that outside emissions prevented attainment. The submission must include modeling or monitoring evidence of emissions from other States and foreign countries.
- EPA and timeline: The EPA Administrator would have 180 days after submission to concur or nonconcur. If the Administrator concurs the redesignation must be promulgated.
- Downwind communities and upwind sources: Areas that can show external pollution blocked attainment could gain federal attainment status despite local struggles. The provision expressly overrides clause (iii) of section 107(d)(4)(A) and requires consideration of interstate and international emissions.

Redesignation when ozone comes from other States
If enacted, a Governor could ask EPA to redesignate a local ozone nonattainment area as attainment when pollution from other States or foreign countries kept it from meeting the ozone standard by its deadline. The Governor could submit the finding at any time on the Governor's own motion. The Governor would have to show the area would have met the NAAQS by the applicable attainment date but for out-of-State or foreign ozone or precursors. The EPA Administrator would have 180 days to concur or nonconcur. If the Administrator concurs, EPA would promulgate the redesignation. The Governor and EPA would consider modeling or monitoring evidence of emissions from other States and foreign countries. This pathway would override an existing restriction that can otherwise block such redesignations.
