  • Importers: Would stop paying duties on Moroccan phosphate and would be eligible for refunds of cash deposits within 90 days, except for duties assessed in administrative reviews completed earlier.
  • Trade agencies: Would be required to stop collecting duties or deposits and implement the revocation; the countervailing duty revocation would take effect 4 business days after enactment and the tariff suspension would start 7 days after enactment.

Lower fertilizer costs for farmers

If enacted, the bill would remove certain U.S. trade duties on phosphate fertilizers imported from the Kingdom of Morocco. Four business days after enactment, the countervailing duty orders issued April 7, 2021 would no longer apply to Moroccan phosphate imports. The Secretary of Commerce would have to stop collecting duties or cash deposits that violate that revocation, but duties assessed in administrative reviews completed before that date could still be collected. U.S. Customs and Border Protection would have to refund cash deposits for Moroccan imports not covered by that exception within 90 days after enactment. Also, seven days after enactment, duties under sections 122 or 301 of the Trade Act of 1974 would not apply to items in HTS headings 3103 or 3105 when imported from Morocco. Importers and farmers would likely pay less for these fertilizers.
