CHARTER Act

Sponsored By: Representative DeLauro, Rosa L. [D-CT-3]

Introduced

Summary

Block for-profit companies from operating federally funded charter schools. The CHARTER Act would bar contracts that let for-profit entities operate, oversee, or manage charter schools that receive Elementary and Secondary Education Act or Individuals with Disabilities Education Act funds, while keeping narrow exceptions for routine services.

Show full summary
  • Charter schools and authorizers would have to avoid contracts that give for-profit entities operational control or let nonprofits subcontract that control. The restriction applies to contracts entered into, renewed, or extended on or after enactment after a 3-year delay.
  • For-profit charter management organizations would be prevented from running or overseeing federally funded charter schools. They could still be paid for explicitly listed services like food, payroll, facilities maintenance, transportation, classroom supplies, and other ancillary services.
  • Students and taxpayers would be protected from federal funds being routed to profit extraction, since the bill aims to keep dollars focused on educational services.
  • Service providers that only deliver the enumerated routine services can continue to contract regardless of profit status because the bill carves out those exceptions.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 0 costs, 2 mixed.

Ban for-profit management of charters

If enacted, this bill would ban a charter school that gets ESEA or IDEA money from signing a contract that lets a for-profit company run, manage, or control the school. The ban would still let schools hire for-profit or nonprofit firms for food, payroll, maintenance, transportation, textbooks, and other ancillary supplies or services. The rule would take effect three years after enactment and would apply only to contracts entered into, renewed, or extended on or after the date of enactment.

Same charter school definition for ESEA and IDEA

If enacted, this bill would make the term "charter school" in both ESEA and IDEA mean the same thing by linking both to the definition in ESEA section 4310. That alignment would take effect three years after enactment and would apply to contracts entered, renewed, or extended on or after the date of enactment.
