PFAS Cleanup Act

Sponsored By: Representative Sánchez, Linda T. [D-CA-38]

Introduced

Summary

A new federal excise tax on PFAS would charge manufacturers, producers, and importers a high fee on PFAS sales to discourage production and raise revenue. The bill would also create a tax credit to help public water system owners pay to remove PFAS that exceed Safe Drinking Water Act limits.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Tax credit for PFAS water cleanup

This bill would create a tax credit equal to 25% of qualified PFAS removal expenses for public water systems you own or operate. You would be able to claim the credit only if you establish to the Secretary that PFAS levels exceed the EPA-promulgated maximum contaminant level under the Safe Drinking Water Act. The credit would be included in the general business credit, would follow controlled-group rules, and would be eligible for elective payment under current rules. The credit would apply for taxable years beginning after December 31, 2026.

Higher excise tax on PFAS

This bill would impose a federal excise tax equal to 45% of the sale price on any PFAS sold by a manufacturer, producer, or importer. If a covered person uses PFAS instead of selling it, that use would be taxed as if sold at fair market value. The bill would define PFAS as any man-made chemical with at least one fully fluorinated carbon atom and require Treasury (with EPA) to issue rules. The tax would apply for taxable years beginning after December 31, 2026, and revenue rules for Puerto Rico and the Virgin Islands would not apply to this tax.
