Sponsored By: Representative Taylor, David J. [R-OH-2]

Creates a federal Commercial Driver's License database tied to immigration verification. This bill would link the Federal Motor Carrier Safety Administration's CDL records to the Systematic Alien Verification for Entitlements (SAVE) system to flag non‑domiciled CDL holders for immigration review.

Show full summary
  • Non‑domiciled CDL holders and drivers: States would need to submit each non‑domiciled CDL holder's license copy and expiration date to FMCSA. FMCSA would run those records through SAVE and refer anyone who appears unlawfully present to U.S. Citizenship and Immigration Services for investigation of removal eligibility.
  • State driver license agencies: States would be required to send specified CDL data to FMCSA but could seek waivers under the bill's amendment to existing waiver authority. The measure creates enforcement and federal withholding mechanisms for states that do not comply.
  • Federal agencies and oversight: U.S. Citizenship and Immigration Services would be required to make SAVE available to FMCSA within 90 days, and FMCSA would report to Congress not later than one year and then annually on how many non‑domiciled CDLs were flagged and the states of issuance.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 1 costs, 1 mixed.

New checks for non-domiciled CDL holders

This bill would require State driver license agencies to send to FMCSA the expiration date and a copy of the current driver’s license for every non-domiciled commercial driver’s license they issue. It would require USCIS to make the SAVE verification service available to FMCSA within 90 days of enactment. FMCSA would run each State submission through SAVE and, if SAVE indicates possible unlawful presence, send the person’s information to USCIS. USCIS would investigate to decide removal eligibility. FMCSA would report to Congress within one year and then every year how many non-domiciled CDLs were flagged and which State issued them.

State waivers and funding penalties

This bill would let States request waivers, exemptions, or pilot program status for the new CDL database rules under the existing waiver authority. It would also add the new database to the list of requirements that can trigger withholding of federal funds from noncompliant States. These changes would take effect upon enactment.
