Russia is a State Sponsor of Terrorism Act

Sponsored By: Representative Lieu, Ted [D-CA-36]

Introduced

Summary

Designates the Russian Federation as a state sponsor of terrorism. This bill would apply that label to key U.S. authorities and other laws and ties the move to findings about Russian attacks, civilian casualties, deportations of Ukrainian children, and support for proxy mercenary forces, while carving out protections for Ukrainian food exports and humanitarian aid.

Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

Protect Ukraine farm exports and aid

If enacted, this would say that nothing in the bill may be used to impose sanctions on people who export agricultural products from Ukraine or who provide humanitarian assistance there. The protection would start on the date of enactment. It would end the earlier of (1) when the Secretary of State says Russia and Ukraine have begun negotiations to end the conflict, or (2) five years after enactment. This would reduce legal risk for exporters, traders, and aid groups doing those transactions.

Bar courts from seizing Russian assets

If enacted, this would bar courts from attaching or executing on blocked or frozen assets of the Russian Federation to satisfy judgments tied to this designation, notwithstanding other laws. The rule would apply to assets frozen as state property and take effect on enactment. The provision would preserve the President and Treasury's authority to administer, license, transfer, or otherwise dispose of those assets to support U.S. foreign policy, including aid to Ukraine and implementation of the REPO for Ukrainians Act. The bill also says victims can still seek compensation from other lawful sources.

Declare Russia a state sponsor

If enacted, this would deem the Russian Federation a state sponsor of terrorism for purposes of the Export Control Reform Act, the Foreign Assistance Act, the Arms Export Control Act, and any other law. The designation would take effect on the date of enactment. It would end the earlier of (1) when the Secretary of State says Russia and Ukraine have begun negotiations, or (2) five years after enactment. If enacted, this could trigger export controls, foreign aid limits, and arms export rules that affect exporters, banks, and supply chains and could also affect prices or deliveries for households.
