Protecting U.S. Farmland and Sensitive Sites From Foreign Adversaries Act
Sponsored By: Representative Moolenaar, John R. [R-MI-2]
Introduced
Summary
Expands federal review of foreign purchases of U.S. farmland and sensitive sites to block access by designated foreign adversaries to ports, data centers, power plants, and agricultural biotechnology. It would broaden CFIUS powers, add food security as a formal factor, and create a presumption that some "elevated risk" land deals pose national-security threats unless cleared by clear and convincing evidence.

- Families and consumers: Would require CFIUS to weigh current and long-term U.S. needs for food, water, and agricultural products, so transactions that could affect local or national food security face closer review.
- Farmers and agricultural landowners: Would make purchases of agricultural land and related biotechnology a specific CFIUS focus and name the Secretary of Agriculture as the Agriculture Representative for those reviews. Many "elevated risk" real estate deals would be presumed to present unresolvable national-security risks unless the Committee shows otherwise.
- Foreign investors and owners of critical sites: Would expand covered real estate to include airports, maritime ports, submarine cable landing stations, data centers, critical communications infrastructure, and power plants. It defines "foreign adversary" to include China, Russia, Iran, North Korea, Cuba, and Venezuela and raises the odds that purchases or leases by those actors are blocked or require mitigation and congressional notification.

Foreign buyers face land review
If enacted, this bill would expand federal review of U.S. real estate purchases, leases, and concessions by some foreign buyers. It lists China, Cuba, Iran, North Korea, Russia, and Venezuela as foreign adversaries. A property near a listed sensitive site or AFIDA-covered farm land would be an "elevated risk" transaction. Parties to an elevated-risk deal would have to file a mandatory declaration. CFIUS would presume these deals are unresolvable security risks unless it proves otherwise by clear and convincing evidence and notifies congressional committees. The Agriculture Secretary would be the agriculture representative for farm and biotech cases. CFIUS would have 120 days after enactment to issue rules. The bill would not override generally applicable State laws that restrict such purchases.
