Federal preemption of state limits on medication abortion. This bill would state that medication abortion is an extremely safe medical treatment and that FDA approval preempts state laws that require medication abortion to be dispensed in person or that prohibit or restrict prescribing or dispensing by telehealth.

Show full summary
  • Patients and families: Would protect access to medication abortion by telehealth and remote dispensing when consistent with FDA approval, making it easier to obtain care without in-person visits.
  • Clinicians and telehealth providers: Would allow prescribing and dispensing via telehealth under FDA authorization, reducing conflicts with state rules that limit remote care.
  • State regulators: Would be barred from enforcing laws that force in-person dispensing or that ban or restrict telehealth prescribing or dispensing of FDA-approved medication abortion.

Protect telehealth medication abortion access

If enacted, this bill would say medication abortion is an extremely safe medical treatment. It would say the FDA approved it based on scientific evidence. It would bar States from enforcing laws that require in-person dispensing of medication abortion. It would also bar State bans or limits on telehealth prescribing or dispensing when FDA approval allows it. You would be able to get medication abortion by telehealth or at a pharmacy when FDA approval permits. The bill would not create new funding or individual entitlements.
