Title IX Clarification Act of 2026
Sponsored By: Representative Arrington, Jodey C. [R-TX-19]
In Committee
Summary
Biological sex is set as the defining standard for Title IX, replacing broader or perceived-sex tests with binary, anatomy-based definitions of "male" and "female." The bill would add precise reproductive-anatomy definitions to Title IX and tie discrimination reviews to those definitions for educational programs that receive federal funds on or after enactment.
Show full summary
- Schools and colleges that get federal financial assistance would use the bill's biological, binary definitions when applying Title IX. This applies to programs and activities that receive federal funds on or after enactment.
- Students whose sex is not captured by those anatomy-based definitions could see discrimination claims assessed under the bill's narrower standard. This changes the legal basis for some Title IX disputes.
- Federal agencies and courts would interpret Title IX through these new definitions, but the bill does not create new programs, funding, or enforcement tools. It is an interpretive, definitional change meant to guide administration and litigation of Title IX.

Bill Overview
Analyzed Economic Effects
2 provisions identified: 0 benefits, 0 costs, 2 mixed.
Defines sex as biological
If enacted, the bill would define 'sex' in Title IX as an individual's biologically determined sex: male or female. It would define 'female' by reference to producing, transporting, and using the large gamete (ova), and 'male' by reference to producing, transporting, and using the small gamete (sperm). Schools and other programs that receive federal education funds would apply these definitions for Title IX when the law takes effect. This would limit sex-discrimination analysis to biological sex and binary categories.
When new Title IX rules start
If enacted, the bill would make these Title IX changes effective on the date of enactment. The amendments would apply to education programs and activities that receive Federal financial assistance on or after that date. Schools and colleges would need to follow the new rules for covered programs as soon as they get federal education funds. This timing could change how students and staff are treated by their schools.
