Show full summary
  • Parents would get a written notice of options — private or common burial, cremation, or disposal — no later than 6 hours after the loss or at discharge. If a parent signs the form to arrange burial or cremation, the facility would ensure the disposition follows the state's fetal death disposition options within 72 hours.
  • Hospitals and freestanding birth centers would have to use the Secretary's notice form and follow the 6-hour notification and 72-hour disposition timelines. The requirement would begin 30 days after enactment.
  • Any individual harmed by a violation would be able to bring a civil action in federal district court for appropriate relief.

Notice rights after miscarriage for parents

If enacted, hospitals and freestanding birth centers would have to notify you after a miscarriage or stillbirth. The notice would use a form the Secretary develops and must be given within 6 hours or by the time you are discharged. If you sign that form within 72 hours to arrange burial or cremation, the facility would follow the State's fetal death disposition rules. The requirement would start 30 days after enactment. A person harmed by a violation could sue in federal court for relief.
