Sponsored By: Representative Raskin, Jamie [D-MD-8]

Introduced

Show full summary
  • Officers and families: Provides cash awards for economic and noneconomic losses and for death. Death claims would receive at least $5.0 million and awards must be paid within 180 days after the Special Master issues a determination.
  • Claimants and process: Claims must document service on January 6, harms suffered, losses, and other payments received. Claims must be filed within three years after the rules are issued and the Special Master generally must issue a final written decision within 120 days of a claim.
  • Administration and recovery: The Attorney General would appoint a Special Master to run the program, set rules, and hire staff. The law reserves the United States’ right of subrogation and treats the program as an obligation of the federal government.

Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

Payments, offsets, and death minimums

If enacted, any approved death claim would pay at least $4,975,000. The bill would also require, after the claim period ends, a one-time equalizing payment to every officer equal to ($4,975,000 plus certain settlement money) divided by the total number of claimants. Awards would be reduced dollar-for-dollar by other payments you received or are entitled to for the same January 6 loss, and the United States could try to recover money from third parties after paying a claim. The Special Master could not award punitive damages. Payments authorized after a determination would be paid within 180 days.

Who can file and how claims work

This bill would create a federal compensation program for law enforcement officers who defended the U.S. Capitol on January 6, 2021. You would file one claim on a standard form that asks about your service, injuries or death, money lost, and other payments. You would have three years to file after the implementing regulations are published, and only one claim is allowed per person. The Special Master would decide eligibility and must issue a written determination within 120 days; that decision would be final.

Special Master office and funding

The bill would let the Attorney General appoint a Special Master to run the program and hire staff. It would authorize "such sums as may be necessary" to pay administrative and support costs for the Special Master. The bill would also let the government record the compensation obligations as budget authority before a separate appropriations Act.
