Show full summary
- Individuals with ITINs: Could have their tax-identifying information shared with DHS for immigration checks, including other identifying details Treasury deems reasonably necessary.
- Department of Homeland Security: Would gain targeted access to ITIN-linked records to use solely for enforcing immigration laws, and must safeguard disclosed data while subjecting it to taxpayer-information penalties.
- Treasury and IRS operations: Would face a new legal duty to respond to written DHS requests and provide the specified ITIN-related information.
- Housing and homebuyers: The bill includes findings that link ITIN use and illegal immigration to rising housing costs and competition for homes, framing the disclosure as a tool to address those concerns.

Tax data sharing for ITIN holders
This bill would require the Treasury Secretary to give DHS certain tax records for people issued an ITIN. DHS would have to make a written request and say it is for enforcing U.S. immigration laws. Records would include name, address, ITIN, filing status, spouse ITIN, and claimed dependent ITINs if the dependent is over age 18. DHS would have to use the records only to enforce immigration laws. The records would remain protected under the same IRS safeguards and penalties that apply to taxpayer information. The change would take effect after the date of enactment.
