DHS Surveillance Technology Moratorium Act of 2026

Sponsored By: Representative Goldman, Daniel S. [D-NY-10]

In Committee

Summary

A moratorium on the Department of Homeland Security's use and procurement of specified surveillance technologies. This bill would pause new purchases, renewals, expansions, and options for tools that identify, locate, or track people until independent audits, public reporting, and new safeguards are completed.

Show full summary
  • DHS agencies and contractors: It would bar obligations or spending for new or expanded covered contracts across ICE, CBP, USCIS, the Office of Intelligence and Analysis, and any other component the Secretary names. It would not allow the bill alone to force the end of contracts already in effect.
  • Transparency and oversight: The DHS Inspector General would have 180 days to complete a detailed audit, followed by an unclassified public report within 60 days that catalogs technologies, contractors, data uses, retention and sharing policies, and privacy impact assessments with limited national security redactions.
  • Waivers and future checks: The Secretary could grant case-by-case waivers for imminent violence or specific national security threats with a seven-day notice to Congress. The moratorium would end only after the audit, the public report, and a 90-day period after Congress gets a further DHS report on safeguards, plus annual post-moratorium reporting starting at least one year later.

Which DHS surveillance contracts are covered

If enacted, this bill would define what counts as a "covered contract" and what tools are "covered surveillance technology." It would say a covered contract is any DHS agreement that uses surveillance tools to identify, find, or track people or to help immigration enforcement. It would list covered technologies such as facial recognition, social media monitoring, phone location tracking, geolocation analytics, predictive analytics, AI targeting, and data-aggregation platforms. It would also specify that "Secretary" means the Secretary of Homeland Security. These definitions would determine which DHS contracts, vendors, and people’s data face the bill’s moratorium and related rules.
