District of Columbia Courts Judicial Vacancy Reduction Act

Sponsored By: Representative Norton, Eleanor Holmes [D-DC-At Large]

Introduced

Summary

President would appoint DC judges only from the District of Columbia Judicial Nomination Commission's recommended list. The bill would replace the current nomination-and-Senate-confirmation language with an appointment model tied to the Commission and add a time-limited congressional veto that can block appointments through an expedited disapproval resolution within 30 days.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 0 costs, 2 mixed.

Congress can block D.C. judicial appointments

If enacted, the bill would make many D.C. judicial appointments take effect only after a 30-calendar-day notice period to Congress. That 30-day period would exclude Saturdays, Sundays, holidays, and long adjournments when neither House is in session. The appointment would be blocked if a joint resolution disapproving it becomes law during the period. The President must send notice for certain appointments and the D.C. Judicial Nomination Commission must send notice for others, and expedited procedures would apply to any disapproval resolution. For nominees pending on enactment, notice would be treated as sent on the enactment date in specified cases.

New appointment process for D.C. judges

If enacted, this bill would change D.C. court law to use appointments instead of Presidential nomination and Senate confirmation. The President would have to appoint judges only from a list the D.C. Judicial Nomination Commission provides. If the President fails to appoint someone on that list, the Commission would appoint that person. These wording and process changes would apply to appointments made on or after enactment.
