Find Our Families Act of 2026

Sponsored By: Representative Tlaib, Rashida [D-MI-12]

In Committee

Summary

This bill would create a public, multilingual detainee locator and add new transparency rules for medical transfers and CBP arrest reporting to improve family access and oversight. It would require faster postings of custody data and routine public reports on enforcement activity.

Show full summary
  • Families and legal representatives would get faster, clearer notifications for medical transfers, including facility contact details and the reason for transfer, with a required family notice within 5 hours and correction acknowledgments within one week.
  • Detainees would be easier to find because the locator must post key custody data within 8 hours, be searchable by registration number, name, or birth data, exclude information on people under 18, and keep records at least 60 days after release. Long in-transit transfers must show origin, destination, mode, and an estimated arrival time.
  • DHS staff, contractors, and the public would face stronger accountability. Personnel who fail to post timely data could face furlough, pay or grade cuts, or suspension up to 30 days, contractors can lose renewals, and DHS must report on enforcement operations every 90 days with counts, costs, and involved personnel.

Bill Overview

Analyzed Economic Effects

5 provisions identified: 4 benefits, 1 costs, 0 mixed.

Public detainee locator for families

If enacted, the bill would require DHS to run a public online detainee locator for people held by CBP or ICE. The locator would post A-number, full name, birth date, country of birth, date and time taken into custody, facility name and address, and facility contact within 8 hours of detention. The site must keep that information at least 60 days after release or removal, update transfers within 8 hours, and show extra routing details for transfers in transit over 5 hours. The site must be in English, Spanish, Haitian Creole, the DHS Officer for Civil Rights and Civil Liberties' top-10 first-languages from last fiscal year, and any language required under Title VI. The locator would not display the listed information for people under 18 and must include a secure public form to report wrong or missing data, with fixes acknowledged and resolved within one week.

Quarterly reports on border operations

If enacted, the bill would require DHS to review any CBP enforcement operation active in the prior 90 days and report to the House and Senate Homeland Security Committees not later than 90 days after enactment and every 90 days after that. Each report would list agents and other officers involved, operation location and justification, counts of arrests with and without warrants, arrests during protests, counts of citizens and non-citizens arrested, costs, and any public or private contracts used. The reviews would increase regular congressional and public oversight of CBP operations.

Notifying families for medical transfers

If enacted, the bill would require DHS to notify a family member and any legal representative within 5 hours when a detained person is moved for medical care. The notice would give the receiving facility's name, address, and phone, the CBP or ICE office contact overseeing the transfer and care, the arrival date and time, and the symptoms or medical assessment that led to the transfer. It would also include any medical status or diagnosis information provided by medical staff. Families or lawyers could not be denied or blocked from visiting unless the detained person says no.

Public posting of border arrest details

If enacted, the bill would require DHS to post certain details about any person arrested by U.S. Customs and Border Protection on the DHS "stats and summaries" web page. Posts would show where and when the arrest happened, how the person was taken into custody, whether an administrative or judicial warrant existed, the person's country of birth, post-arrest facility name and address, and citizenship. The bill would also provide a secure public form for family members or legal representatives to report wrong or missing arrest information, with DHS required to acknowledge and resolve reports within one week.

Penalties for failure to report detainees

If enacted, the bill would require ICE or CBP leaders to investigate employees who fail to provide required detainee locator data and, where appropriate, take personnel actions such as furlough, reduction in pay or grade, or suspension up to 30 days. The bill would also require referral of such investigations to the DHS Office of Inspector General. In addition, the Secretary would be barred from renewing any contract with a facility or contractor that failed to provide timely or accurate locator data.
