Artificial Intelligence Data Center Moratorium Act

Sponsored By: Representative Ocasio-Cortez, Alexandria [D-NY-14]

Introduced

Summary

A nationwide moratorium on the construction and upgrading of AI data centers would pause new and expanded facilities until Congress enacts laws requiring safety reviews, worker and community protections, and environmental and utility safeguards. The bill ties the moratorium’s end to laws that demand federal pre-release review of AI products, protections to share economic gains with workers, community approval, bans on subsidies, and limits to prevent higher utility bills or increased climate harm.

Show full summary
  • Households and communities: Local residents would get authority to approve or reject new or upgraded AI data centers. Projects would have to meet rules aimed at preventing higher utility bills and limiting climate and environmental harms.
  • Workers: Facilities built or upgraded after the moratorium would be required to provide union jobs, prevailing wages, registered apprenticeships, and project labor agreements. The bill also directs laws intended to prevent job displacement and to make sure AI-generated economic gains benefit U.S. workers.
  • Industry oversight and global trade: Operators would face quarterly Department of Energy reports covering energy and water use, greenhouse gas and air emissions, wastewater, cooling chemicals, noise, wages, jobs created, land and utility deals, and certification of no subsidies. The Secretary of Energy could verify data with subpoenas, interrogatories, inspections, and by conditioning permitting, and the bill would bar exports of AI computing hardware to countries that lack comparable statutes or regulations and would restrict certain end uses.
