Spot the Fakes Act
Sponsored By: Representative Gottheimer, Josh [D-NJ-5]
Introduced
Summary
Requires mandatory labeling of AI-generated content so that every AI-created image, video, audio, text, or other medium carries an indelible provenance tag. This bill would make the Federal Trade Commission work with the National Institute of Standards and Technology to set how that tag appears in metadata or other technical means.
Show full summary
- Content creators and platforms would have to attach an AI-generated label to outputs in metadata or by other technological methods set by NIST. The label must be indelible and verifiable.
- Consumers would see provenance information built into the files or streams they access, because the label must travel with the content via metadata or specified tech.
- The Federal Trade Commission would issue rules within six months in consultation with NIST and enforce failures to label as unfair or deceptive acts under existing FTC Act authorities. Definitions of "artificial intelligence" and "AI-generated content" follow the National Artificial Intelligence Initiative Act of 2020.
