Summary

Excludes veterans' disability benefits from income when determining eligibility for certain HUD veteran housing programs. This bill would make disability payments under title 38, chapters 11 and 15 not count as income for HUD's supported housing under section 8(o)(19) and for specified future HUD programs on Department property.

  • Veterans and applicants: Veterans who receive disability benefits under title 38, chapters 11 or 15 would not have those payments counted as income when applying for the HUD supported housing program under section 8(o)(19). This exclusion may not apply to the definition of adjusted income in other eligibility calculations.
  • Households and other housing assistance: Households getting rental help through 8(o)(19) would have those disability payments excluded when checking eligibility for other types of housing assistance. The bill also requires HUD to exclude those benefits for rentals in housing built on Department property under future HUD-administered programs.

VA disability pay ignored for HUD housing

If enacted, veterans’ disability pay under title 38, chapters 11 or 15, would not count as income for HUD’s supported housing under Section 8(o)(19). If your household receives that rental help, those benefits would also be left out when checking your eligibility for other HUD housing assistance. The exclusion would not change how “adjusted income” is defined. HUD would also have to ignore these benefits when checking a veteran’s eligibility to rent units built on Department of Veterans Affairs property after enactment under future HUD programs.
