TPS Review Act

Sponsored By: Representative Wasserman Schultz, Debbie [D-FL-25]

Introduced

Summary

This bill would strengthen and formalize judicial review and procedural safeguards for Temporary Protected Status (TPS) terminations by requiring detailed written findings, preserving the administrative record, and keeping TPS benefits in place during court challenges. It ties TPS termination timing to explicit publication rules and subjects terminations to the rules for major federal actions under the Congressional Review Act.

Bill Overview

Analyzed Economic Effects

4 provisions identified: 4 benefits, 0 costs, 0 mixed.

Pause Temporary Protected Status terminations

If enacted, the bill would pause any Temporary Protected Status (TPS) termination that is being challenged in court until the case ends. While the case is pending, the affected TPS grants would remain in effect and beneficiaries would remain authorized to be in the United States. Employment authorization based on TPS would stay valid and the Secretary would automatically extend work permits as needed. The bill would also require DHS to compile, certify, and preserve a complete administrative record and limit ordinary court review to that record except in narrow, extraordinary cases.

Rules before ending Temporary Protected Status

If enacted, the bill would treat any DHS action that ends, partly ends, or materially reduces a TPS designation as a major rule under the Congressional Review Act. Such a termination would have no force until required CRA submissions and any major-rule waiting periods are complete. The bill would make termination a final agency action subject to judicial review and allow individuals, classes, organizations, and States to sue in federal court. DHS would have to base a termination on a certified administrative record and publish written findings in the Federal Register that address statutory bases, country conditions, inconsistent evidence, and that the decision did not rely on constitutionally impermissible considerations. A termination could not take effect earlier than 60 days after Federal Register publication (or later if tied to the most recent extension).

Review process for Temporary Protected Status denials

If enacted, the bill would require the Secretary of Homeland Security to create an administrative procedure to review denials of TPS benefits. Applicants denied TPS would have a non‑judicial route to seek reconsideration. The bill would also make clear that an administrative review process would not stop an individual from asserting TPS protection in removal proceedings if they are a national of a designated state.

When Temporary Protected Status rules apply

If enacted, the bill's changes would apply to any designation, redesignation, extension, or termination under section 244 made on or after the date the law is passed. The changes would also apply to any civil action challenging such a determination that is pending on, or filed after, the date of enactment. This timing rule decides which cases and decisions get the bill's procedural protections.
