Impeaching James E. Boasberg, United States District Court Chief Judge for the District of Columbia, for high crimes and misdemeanors.

Sponsored By: Representative Gill, Brandon [R-TX-26]

Introduced

Summary

Impeachment for abuse of power. This resolution would accuse Chief Judge James E. Boasberg of authorizing nondisclosure orders and subpoenas tied to Special Counsel John L. Smith and an FBI project called ARCTIC FROST. The Article of Impeachment says those orders covered lawmakers acting on legislative duties and targeted conservative groups and activists.

  • Judge Boasberg: The resolution would declare him guilty of high crimes and misdemeanors and says he deserves removal for allegedly abusing his office, citing an order that prevented AT&T from notifying Senator Cruz of a subpoena for at least one year.

Judge barred AT&T from telling Cruz

If adopted, the resolution would allege that Chief Judge Boasberg signed an order preventing AT&T from telling Senator Ted Cruz he was subpoenaed for at least one year. The order is said to rest on a finding that disclosure could lead to evidence tampering, witness intimidation, and serious jeopardy to the investigation. The resolution disputes that the judge had a clear reasonable basis for that finding.

Nondisclosure orders targeted lawmakers

If adopted, the resolution would allege that Chief Judge Boasberg authorized nondisclosure orders that covered multiple Members of Congress acting in their legislative roles. The resolution names several Senators and one Representative and calls those orders frivolous and an undue legal burden. It would also allege that subpoenas targeted conservative nonprofit groups and activists to silence political speech. The resolution cites 2 U.S.C. Sec. 6628 and says that statute protects a Senate office and its providers from being barred from notifying the office when legal process seeks their electronic data.
