119-s-1099119th Congress

Nationwide Injunction Abuse Prevention Act of 2025

Sponsored By: Senator Hawley, Josh [R-MO]

Introduced

Summary

This bill would sharply curb federal district courts' power to issue nationwide injunctions by confining injunctions to the parties in the case or to the issuing court's district. It bars district courts from entering temporary or preliminary injunctions that extend beyond the named parties or the geographic bounds of the court.

  • Federal agencies and national rules: A single district court could not block a federal rule nationwide. Any injunction would halt enforcement only for the named parties or within that court's district.
  • States and private plaintiffs: States, businesses, or individuals could win injunctions that affect only their case or their district, not the whole country.
  • District courts and judicial practice: The measure curtails broad, nationwide judicial remedies by adding a statutory rule that overrides other laws that might allow broader relief.

Limits nationwide court injunctions

This bill would bar most nationwide or multi‑state injunctions from federal district courts. If enacted, a district court could only order an injunction that applies to a party in the case. Or the order could apply only to the court's own judicial district. It would also cover temporary restraining orders and preliminary injunctions and stop those orders from applying beyond the parties or the district. If passed, this could make it harder for people, businesses, or states to get orders that stop actions nationwide.
