Bill Overview
Analyzed Economic Effects
3 provisions identified: 1 benefits, 1 costs, 1 mixed.
New approval and fees for firearm makers
If enacted, any semi-automatic firearm designed after enactment would need Attorney General approval before manufacture for sale to civilians in interstate or foreign commerce. Licensed manufacturers would file detailed applications under penalty of perjury, send physical samples, and describe features that prevent modification. The Attorney General must decide within 240 days, set fees within 60 days to cover review costs, and manufacturers could appeal denials. Some of the fees and specified ATF tax receipts would be deposited into a new Firearm Safety Trust Fund to pay for reviews and enforcement.
Ban on certain gas-operated guns
If enacted, this would ban importing, selling, making, transferring, receiving, or possessing gas-operated semi-automatic firearms that the Attorney General/ATF lists. It would also ban large-capacity ammunition feeding devices that hold more than 10 rounds. The bill would add definitions for 'gas-operated' and 'large-capacity', require the ATF to publish a prohibited list within 180 days, and set marking and serial-number rules. Possession of guns and magazines made and acquired before enactment would generally be allowed, but transfers after enactment would be restricted and limited family and government exemptions would apply. Violating the ban would carry penalties up to $5,000 and up to 12 months in jail, with enhanced fines up to $250,000 and 2–10 years' imprisonment when possession accompanies another federal felony.
Federal grant money for gun buy-backs
If enacted, Byrne grant funds would be allowed to pay people who surrender covered gas-operated semi-automatic firearms and large-capacity magazines in local buy-back programs. State and local governments could use Byrne grants to give compensation to owners who turn in covered items. The bill does not set specific compensation amounts or eligibility formulas.
