Housing Unhoused Disabled Veterans Act
Sponsored By: Senator Padilla, Alex [D-CA]
Introduced
Summary
Excludes certain VA disability benefits from income tests for HUD supported housing. This bill would make disability payments under 38 U.S.C. chapters 11 and 15 not count as income when determining eligibility for HUD's supported housing program under section 8(o)(19) and for HUD-funded housing on Department property.

- Veterans receiving disability pay: Their chapter 11 or 15 benefits would be ignored in income checks for the Section 8(o)(19) supported housing program, which could increase their chances of qualifying for that assistance.
- Households getting rental assistance under 8(o)(19): When assessing eligibility for other HUD housing help, those veterans' VA disability benefits would be excluded from household income calculations.
- Veterans renting units on Department of Veterans Affairs property: HUD-administered assistance for units constructed on Department property would exclude those disability payments from income tests. The bill preserves the current definition of "adjusted income" by excluding these benefits only for eligibility checks, not from adjusted income calculations.

VA disability pay not counted for HUD
If enacted, this bill would stop HUD from counting a veteran's disability benefits under 38 U.S.C. chapters 11 and 15 as income when deciding eligibility for HUD's supported housing program (section 8(o)(19)). It would also require HUD to exclude those same VA disability benefits when determining a veteran's eligibility to rent HUD-assisted homes built on Department property on or after enactment. The exclusion would apply when HUD checks income for households getting rental help under the supported housing program for other HUD assistance. The bill says this exclusion would not change the 'adjusted income' amount used elsewhere.
