Sponsored By: Senator Cantwell, Maria [D-WA]

In Committee

Summary

Transfers about 1,082.6 acres of federal land into trust for the Lower Elwha Klallam Tribe, expanding the Tribe's Reservation. It waives standard federal valuation and appraisal requirements for that land, sets specific river-management rules for Elwha River parcels, and bars treating the transferred parcels as Indian lands for gaming purposes.

Lower Elwha Tribe land transfer

If enacted, the bill would take about 1,082.63 acres of federal land shown on the December 2021 Olympic National Park map into trust for the Lower Elwha Klallam Tribe. The land would become part of the Lower Elwha Indian Reservation. The Secretary of the Interior would survey and set boundaries, and could make small map or acreage corrections. The bill would waive federal valuation, appraisal, and equalization requirements for this land, prevent it from being treated as "Indian lands" under federal gaming law, and require the Elwha River portion to be managed under the Wild and Scenic Rivers Act as modified by the Elwha River Ecosystem and Fisheries Restoration Act. The bill would not change treaty rights under the Treaty of Point No Point.
