Forest Protection and Wildland Firefighter Safety Act of 2025

Sponsored By: Senator Lummis, Cynthia M. [R-WY]

Introduced

Summary

This bill would clarify that aerial applications of fire-control and suppression products on the Forest Service's Qualified Products List are exempt from NPDES permits. It would amend the Federal Water Pollution Control Act (33 U.S.C. 1342(l)(3)) to add those aerial discharges to the statute's list of permit-exempt discharges and would update several internal cross-references so the new clause fits the law's structure.

Fewer water permits for aerial firefighting

This bill would add an exemption to the Clean Water Act for certain aerial firefighting discharges. If enacted, discharges from aerial application of products used for fire control would not need NPDES permits when the product appears on the Forest Service Qualified Products List (or a successor list). The change would apply upon enactment. It could speed wildfire response and lower permitting costs for Forest Service crews and private contractors, but it would also reduce federal permitting oversight of some discharges to water.
