A bill to remove the lesser prairie-chicken from the lists of threatened species and endangered species published pursuant to the Endangered Species Act of 1973, to amend that Act to exclude the lesser prairie-chicken from the authority of that Act, and for other purposes.
Sponsored By: Senator Marshall, Roger [R-KS]
Introduced
Summary
Removes the lesser prairie-chicken from the Endangered Species Act lists and bars future ESA listings for that species. The bill would take the lesser prairie-chicken (Tympanuchus pallidicinctus), including any distinct population segments, off the federal lists of threatened and endangered species. It would amend ESA section 4(a) so the Secretary may not determine the species to be threatened or endangered. The amendment would apply notwithstanding other law.

Remove federal protections for lesser prairie-chicken
If enacted, this bill would remove the lesser prairie-chicken (Tympanuchus pallidicinctus) from the federal endangered and threatened species lists. It would bar the Secretary from ever listing the species again, including any distinct population segments. The change would take effect upon enactment and would operate notwithstanding other law. Landowners, ranchers, developers, and energy companies in the bird's range would likely face fewer federal land-use rules and permitting limits. Conservation groups and local communities would lose legal protections and federal conservation requirements for the species.
