Expanded expedited removal for immigrants
If enacted, the bill would let the Secretary of Homeland Security apply expedited removal to a much broader set of noncitizens. The Secretary could do this for anyone inadmissible under paragraph (6) or (7) of section 212(a) and could change that policy at any time. The Secretary's decision would be described as the sole and unreviewable discretion of the Secretary, limiting judicial review. The bill would also move certain decision roles from the Attorney General to the Secretary of Homeland Security. It would raise one legal proof standard from "a significant possibility" to "clear and convincing evidence." These changes would take effect upon enactment and could increase removal risk and reduce procedural protections for affected noncitizens and their families.
