Show full summary
  • Foreign buyers, lessees, or concessionaires owned, controlled by, acting for, or receiving subsidies from Russia, China, Iran, or North Korea would face mandatory CFIUS review for property within 100 miles of a military installation or within 50 miles of specified military airspace, training routes, or operations. CFIUS must open a review for these transactions.
  • Energy developers and infrastructure projects on land subject to those reviews would see Department of Defense and Department of Transportation determinations delayed until CFIUS concludes its action, and DoD must notify Transportation of any delay.
  • If CFIUS refers a transaction to the President as a national security threat, DoD would be required to find the project poses an unacceptable risk and transmit that finding to Transportation for inclusion in its report.
  • Members of Congress from the state and congressional district where the property or military asset is located would receive certification and notifications about the CFIUS action.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 2 costs, 0 mixed.

New foreign land reviews near bases

If enacted, this bill would make some foreign land deals near military sites subject to automatic CFIUS review. It would cover purchases, leases, or concessions within 100 miles of a military installation and within 50 miles of certain training routes or military airspace/areas. The rule only applies when the foreign party is tied to Russia, China, Iran, or North Korea. CFIUS would have to start reviews and notify the State's U.S. Senators and the local U.S. Representative. Transactions proposed, pending, or completed on or after enactment could be reviewed.

Energy developers face new delays

If enacted, this bill would pause or block energy project reviews when the land for the project is under CFIUS review. The Defense Department could not finish its review while CFIUS is considering the property and must tell Transportation about delays. The Transportation Secretary could not issue certain approvals until CFIUS closes the matter and DoD issues or declines a national‑security finding. If CFIUS refers the transaction to the President, DoD must find the project poses an unacceptable risk and tell Transportation.
