Show full summary
  • Sturgeon farmers and captive holders: Would not be subject to subsection (a)(1) and section 7(a)(2) for sturgeon legally held in captivity as of enactment and for their progeny while those fish remain in captivity. Holders must be able to demonstrate qualification and maintain inventories and records to provide to the Secretary on request.
  • Secretary and federal regulators: Would get authority to require inventories, documentation, and records by regulation. The statute says those regulatory requirements must not needlessly duplicate other rules under the Act.
  • Wild-return process: Any sturgeon intentionally returned to a wild state would lose the exemption and again be subject to the Act's protections.

New exemption for farmed sturgeon

This bill would exempt sturgeon legally held in captivity on the date of enactment from some Endangered Species Act bans. It would also exempt progeny of those sturgeon while they remain in captivity. The exemption would stop if the sturgeon or progeny are intentionally returned to the wild. Holders would need to prove the fish qualify and keep inventories and records. The Secretary could request those records and must avoid duplicating other ESA rules.
