Show full summary
  • Federal agencies would be barred from buying or using AI on the list unless an agency head grants an exception. Agencies must rely on existing procurement authorities to exclude or remove covered AI.
  • Researchers, testers, and national security teams could get exceptions for scientifically valid research, for evaluation, training, testing, or analysis, for counterterrorism or counterintelligence work, or to protect mission-critical functions.
  • The Federal Acquisition Security Council would build the initial list within 60 days and update it at least every 180 days. The Office of Management and Budget would publish the list on a public website within 180 days.
  • Companies with significant foreign ownership or control could be listed if tied to foreign adversaries but may seek removal by certifying they are not produced or developed by a foreign adversary and passing a council review. Notice to the OMB Director and relevant congressional committees is required when agencies seek exceptions.

Federal limits on foreign-adversary AI

This bill would make a government list of AI produced or developed by foreign adversaries within 60 days and require OMB to publish it within 180 days. The council would update the list at least every 180 days. Federal agency heads would have 90 days to review AI on that list and generally could not buy or use it unless they approve a written exception. Exceptions need notice to OMB and the named congressional committees and are limited to valid research, evaluation/testing, counterterrorism or counterintelligence, or mission-critical needs. AI owners could ask to remove a product by certifying it is not from a foreign adversary and getting council approval.
