119-s-2186119th Congress

Preventing Pretrial Gun Purchases Act

Sponsored By: Senator Booker, Cory A. [D-NJ]

Introduced

Summary

Blocking firearm purchases by people under court pretrial release orders would add a new federal disqualification and expand background-check prohibitions to cover anyone subject to a pretrial release order that bars firearm possession. It would also fund state and tribal reporting to the National Instant Criminal Background Check System to flag those orders in background checks.

  • People under pretrial release orders: Individuals subject to a court-ordered pretrial release that prohibits buying or possessing firearms would be newly disqualified from purchasing or receiving guns under federal law.
  • Licensed sellers and buyers: A knowing sale, transfer, or receipt of a firearm to a person covered by such an order would violate the updated Gun Control Act and related background-check provisions.
  • States and Indian Tribes: Eligible States and Tribes could receive grants to report covered pretrial release orders to NICS. The bill authorizes $25.0 million per year for fiscal years 2026 through 2030 to support reporting activities.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Grants to report pretrial gun orders

If enacted, the Attorney General would be allowed to give grants to States and Indian Tribes to report "covered pretrial release orders" to the federal background-check system (NICS). A covered order is a state, tribal, or local court order that governs release pending trial and forbids the person from having firearms or ammunition. State or Tribal chief executives would need to apply for the grants. The bill would authorize $25,000,000 for each fiscal year 2026 through 2030 to carry out this program, and the grants would be in addition to existing NICS-related grant programs.

Ban gun purchases on pretrial

If enacted, the bill would bar people under a court pretrial release order that forbids buying, possessing, or receiving guns from obtaining firearms. It would add a federal definition for a "pretrial release order" and make those orders a disqualification in federal background checks. Federal gun sellers and licensing rules would treat selling or giving a gun to such a person, or that person receiving a gun, as a violation while the order applies.
