Defense repair access in contracts
This bill would require agencies to sign contracts only if contractors promise in writing to give the Department of Defense fair access to repair materials. Repair materials means parts, tools, and information used to diagnose, maintain, or fix digital electronic equipment. "Fair and reasonable access" would mean (A) DoD can get materials for repair work, (B) prices and terms match the most favorable deals the manufacturer gives its authorized repairers, and (C) if the manufacturer does not sell the item to any repairer, the government would get it on terms the U.S. decides are fair under title 10. The Secretary of Defense would review contracts to find and fix intellectual property limits that block DoD repairs. Agencies could waive the rule for programs that began before enactment only after sending Congress a justification and an independent technical risk assessment. The Comptroller General would report to the congressional defense committees on implementation within 1 year after enactment. The rule would take effect upon enactment.
