Sponsored By: Senator Moreno, Bernie [R-OH]

Show full summary
- Foreign manufacturers: Must answer specified additional questions in approval applications and receive approvals no longer than one year. DOT may extend approval to five years if the maker attests to required conditions and demonstrates three years of compliance.
- Inspections and enforcement: DOT must revise rules to allow annual inspections for good cause. A refusal to inspect can cost a manufacturer's in-good-standing status and DOT may request test and production records, conduct random sample testing, and recover inspection travel and time costs.
- Transparency and public input: DOT must publish notification when an application is received and allow 30 days for public comment before approval. Within 180 days the department must create a process for interested parties to request reevaluation and must publish an annual list of approved foreign manufacturers.

Bill Overview
Analyzed Economic Effects
3 provisions identified: 1 benefits, 0 costs, 2 mixed.
Public list and reevaluation petitions
If enacted, DOT would publish and update each year a public list of approved foreign cylinder makers and the length of their approvals. The first list must be published within one year after enactment. Within 180 days, DOT would also set rules letting any interested party petition for reevaluation of an approval when there is evidence of inaccurate, changed, or fraudulent attestations.
Stronger foreign cylinder inspections and fees
If enacted, DOT would be able to require annual inspections of foreign cylinder makers when there is good cause. Refusing inspection would remove a maker's "in good standing" status. The Secretary could demand test and production records and order random sample testing. The Secretary could suspend or end approvals for obstruction or intentional misrepresentation. Within 180 days after enactment, DOT would be allowed to recover all foreign inspection costs, including travel and staff time.
Tighter approval rules for foreign makers
If enacted, approvals for foreign cylinder makers would default to no more than one year. DOT could grant a five-year approval only if the maker attests none of its cylinders are barred under 19 U.S.C. 1307, certifies application accuracy and reporting, and DOT finds the maker "in good standing" (three years' compliance). Applicants and any entity owning more than 10% would have to answer extra questions about past penalties, Do Not Pay listings, military end-user listings, and certain trade or sanction orders. DOT would post applications on the PHMSA website and allow 30 days for public comment before approval.
