Summary

Protecting ACIP members' independence. This bill would tighten when members of the Advisory Committee on Immunization Practices could be removed and increase reporting when a member is terminated.

Show full summary
  • ACIP members would only be removable "for cause" after notice and an opportunity for a hearing, with "for cause" defined as inefficiency, neglect of duty, or malfeasance.
  • If the Secretary of Health and Human Services terminates a member for cause, the Secretary would have to send a written justification to the Senate Committee on Health, Education, Labor, and Pensions and the House Committee on Energy and Commerce and make that justification public within 1 day.
  • For members who are also Federal employees, a termination for cause would apply only to their ACIP membership and would not affect the protections they hold as Federal employees.
  • The Secretary would immediately revert ACIP membership to how it stood on June 8, 2025, and those reinstated members would finish the terms they had as of June 9, 2025. Future ACIP vacancies would be filled from individuals recommended by the Comptroller General of the United States.

Protect and reinstate vaccine advisers

If enacted, the bill would limit when the Health Secretary could remove members of the advisory immunization committee. Removals would be allowed only for cause — inefficiency, neglect of duty, or malfeasance — and only after notice and a hearing. If the Secretary terminates a member for cause, the Secretary would submit a written justification to the Senate Health, Education, Labor, and Pensions Committee and to the House Energy and Commerce Committee. The Secretary would make that justification public not later than one day after the termination. If a member is also a federal employee, a termination would apply only to the committee seat and not change the person's federal employee protections. The bill would require immediate reinstatement of the committee membership as of June 8, 2025. Reinstated members would serve the remainder of the terms that applied as of June 9, 2025. After reinstatement, any vacancy would be filled by the Secretary from among individuals recommended by the Comptroller General.
