Study on attracting trusted foreign investment

The Commerce Secretary, with other agencies and the Comptroller General, would review how the U.S. attracts foreign investment from trusted countries. The Secretary would publish a notice and take public comments before starting, and again on proposed findings before the report. The review would cover jobs, manufacturing, services, digital trade, data flows, and barriers like forced data localization and industrial subsidies, and would exclude CFIUS laws. A report with recommendations would be due to Congress no later than 1 year after enactment. Only “responsible” firms would be in scope, as determined by the Secretary; a firm would need to be neither organized in, nor owned, controlled, or influenced by, a foreign country of concern.
