A bill to allow for the use of risk-based inspections for in-service breakout tanks.
Sponsored By: Senator Curtis, John R. [R-UT]
Introduced
Summary
This bill would let pipeline owners and operators use risk-based inspections for in-service breakout tanks under existing federal pipeline safety law. The bill would require the Department of Transportation, through the Pipeline and Hazardous Materials Safety Administration, to revise 49 C.F.R. §195.432 as soon as practicable to allow that inspection option. It relies on current definitions in 49 U.S.C. chapter 601 and 49 C.F.R. part 195 and does not create new funding or new eligibility rules.

New inspection option for pipeline owners
This bill would let pipeline owners or operators use risk-based inspections for in-service breakout tanks starting on the date of enactment. The Department of Transportation would have to revise 49 C.F.R. §195.432 as soon as practicable to allow this. Owners could get more flexibility and possibly lower compliance costs. Communities could see changes to safety or fuel-transport reliability depending on how inspections are done.
